General Terms

Items and services of the website are subject to www.escluso.com.cy has the right at any time to modify or withdraw certain terms without notice . Therefore we highly suggest you review this page at every point before visiting or making a purchase to be clear on the correct or revised terms by which you are bound to.

Access to www.escluso.com.cy is permitted on a temporary basis, we have the right to withdraw or make changes to the website without notice. To maintain the website to the highest standard, and make it user friendly for all our customers, we may restrict access to some parts or all of the website. We are not liable if for any reason this website is unavailable.

If you are under 16 you must let your parent or guardian know about Escluso’s Terms and Conditions before you register to use this site or any of this site’s services. However, we reserve the right to only accept orders from those over 18.

Any images, graphics and photographs contained on the website are copyrighted unless stated otherwise. It is forbidden to use them in any manner, unless permission is granted by www.escluso.com.cy or Escluso . Images of people , events or press published on the website , are either property or used with permission by www.escluso.com.cy .Any unauthorized use of images or photographs on this website, may violate copyrights, and/or trademarks.

We take no responsibility for any damages or viruses of use of the website. Links to other websites may appear on this site. If you select to visit these third party sites through our website, you do so at your own risk.

Concerning communicative material through the website, such as answers, questions, comments , suggestions and ideas , these instantly become the property www.escluso.com.cy and can be treated for other users and will appear as non-confidential.

No misuse of this website will be tolerated, including any criminal offence, unnecessary language which may be considered obscene and offensive , breach of confidence or hacking into the server www.escluso.com.cy will report any cases to the relevant Law enforcement authorities in Cyprus, and we have the right to disclose your identity and terminate all accounts. If multiple logins are created for misuse or disruption, legal action will be taken.

REGISTRATION

To use some of the services or features made available to you on this site you need to register. When you register you are required to provide information about yourself that is true, accurate and complete in all respects. We may also change registration requirements from time to time.

The account password you provide should be unique and kept secure, and you must notify Escluso immediately of any breach of security or unauthorized use of your account.

ELIGIBILITY TO PURCHASE :

In order to make purchases on the site you will be required to provide your personal details. In particular, you must provide your real name, phone number, email address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The site is available only to individuals and others who meet the Escluso’ s terms of eligibility, who have been issued a valid/ credit card by a bank acceptable to Escluso, whose applications are acceptable to Escluso and who have authorized Escluso to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase.

By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where Escluso feels necessary, to transmit or to obtain information about you to or from third parties , including but not limited to your credit / debit card number or credit reports, to authenticate your identity , to validate your credit / debit card, to obtain an initial credit/ debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use personal information provided by you in order to conduct appropriate anti fraud checks.

ORDERS

All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

ACCEPTANCE OF YOUR ORDER

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details for your order. This email is Not an acceptance of your order, just a confirmation that we received it.

Unless you cancel your order, acceptance of your order and completion of the contract between you and Escluso will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Nicosia, Cyprus and the language of the contract is English.

We reserve the right not to accept your order in the event , for example that we are unable to obtain authorization for payment , that the item ordered is out of stock or does not satisfy our quality control, standards and is withdrawn or you do not meet the eligibility criteria as set out above.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the site , refusing to process a transaction or unwinding or suspending any transaction after processing has began.

PAYMENT

Payment can be made by Visa, MasterCard and any other methods which maybe clearly advertised on the site from time to time. Payment will be debited and cleared from your account upon dispatch of your order by Escluso . You confirm that the credit/debit card is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/ debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Escluso , we will not be liable for any delay or non delivery.

We take reasonable care to make our site secure. All credit/ debit card transaction on this site are processed using data cash, secure on line payment gateway that encrypts your card details in a secure host environment. If you are a registered Escluso user, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the site.

PRICING POLICY:

Prices shown on the site are in Euros and are inclusive VAT. All prices on the site are subject to change. If an item has been ordered, before it has been processed, if a discrepancy or error has occurred in the price, you have the right to either to cancel the item or confirm to the new corrected price. If for any reason we are unable to contact you, from the information provided by you, we will consider the item/ items cancelled.

Taxes:
We are required by law to collect all taxes based on where your order is being
shipped. When you review your order total during the checkout process, you'll
see the estimated sales tax. The actual charge to your credit card
will reflect the applicable state and local taxes.

Delivery Information

As soon as an order is made and the payment has been received and authorized, we try our very best to ship your item(s). Please note that we are stating the estimated delivery time, and Escluso cannot be held accountable for any third party delays.

Cyprus

For all Cyprus deliveries we use Akis Express . All deliveries are insured and require a signature upon receipt. You will be provided with the tracking number by email.

If no one is available to receive your item, a card will be left offering you the option to have the item delivered on a different date or collected from your local post office.

We try our best to deliver your item(s) within 7 days but as our pieces are made to order, it sometimes may take a bit longer. If you need your items by a specific date please email us at info@escluso.com.cy

Europe & International

For all European deliveries we use EMS/DATA POST services. All deliveries are insured and require a signature upon receipt. You will be provided with the tracking number by email.

If no one is available to receive your item, a card will be left offering you the option to have the item delivered on a different date.

Please note that any additional fees, duty and custom taxes in the country of destination are your responsibility. Customers are advised to check this prior to placing an order with us.

We try our best to deliver your item(s) within 9 days for European countries and within 3 weeks for international deliveries, but as our pieces are made to order, it sometimes may take a bit longer. If you need your items by a specific date please email us at info@escluso.com.cy

Late and lost delays

Items cannot be replaced before they are classified as lost items by the EMS/DATA POST. That is 5 working days for Cyprus and 15 working days for international deliveries after the dispatch date.

On international deliveries, your parcel is usually handled by more than one courier service. Hence when parcels are sent abroad, the actual delivery of your parcel will be their responsibility. Often delays of up to 10 days are caused by customs checks.

Parcels that are tracked as being delivered but not received by the customer (This may happen if you have provided us with your work address, where a colleague within your company or someone else has signed for). In these cases you will need to obtain a proof of delivery certificate from the EMS/DATA POST by filling their signature request form. Please note that Escluso does not refund nor replace items that are tracked as being delivered. For such reasons we recommend that you provide us with your full home address including flat number, floor level, house number, street names and post code for all deliveries.

DISCOUNTS/ SPECIAL OFFERS:

Discounts and Special Offers promoted through the website may not always apply to the fashion Escluso store. The website is a store of its own, and does not always work in sync with the store, therefore we are not responsible for price differences or special deals that may apply in some cases.

GIFT VOUCHER:

When purchasing a gift voucher from the website this can be used at the Escluso shop as well as on the on line store. If you lose the gift voucher in any way, as long as you have noted the date and invoice number, the voucher is still valid. However if the invoice number is lost we can not accept any responsibility. Deliveries of gift voucher applies to same as the accessories. We cannot take any responsibility if the gift voucher or invoice number is used by someone other than the intended recipient.

Gift vouchers are sold subject to the following terms and conditions;

Gift vouchers do not have expiry date.

Gift vouchers can be redeemed against all products on the www.escluso.com.cy site.

Gift vouchers are non transferable and may not be returned or redeemed for cash.

If your order total is less than the value of the Gift Voucher, the remaining balance will be credited to your account and will be credited to your account and will be redeemed against subsequent orders. You may check your Gift Voucher balance online via your my “Account page”.

If your order exceeds the value of the Gift Voucher, the remaining balance must be paid by credit or debit card, unless you have existing Store credit on your account, in which case the Store Credit will be redeemed for the remaining balance of your order. If the remaining balance exceeds the value of the Store Credit as well, you must pay the remaining balance by credit or debit card.

If you return products you have purchased using a Gift Voucher, the remaining balance will be credited to your account as store credit and will be redeemed against subsequent orders. You may check your Store Credit balance online via your my Account page.

Gift Vouchers will be emailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.

Escluso is not liable for delivery of a Gift Voucher to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.

Escluso is not responsible if a Gift Voucher is lost, stolen, destroyed or used without permission.

Escluso reserves the right to cancel a Gift Voucher if we deem such action necessary.

HOW TO PURCHASE A GIFT VOUCHER

Simply enter name in the section “Form” and ‘’To’’ and the amount you wish to submit to the receiver of the voucher. The voucher will then be placed into your shopping bag. Once the payment has been approved, an invoice number will be sent to you. This number is of extreme importance and helps us trace the voucher if lost or misplaced.

You have the option of printing the voucher or sending the voucher to the receivers address, ensure you enter in a different delivery address

RETURNS & EXCHANGES

CANCELLING YOUR ORDER

You have the right to cancel your order with us provided you give us written notice within seven working days of receiving your items.

On receipt of your notice of contract cancellation, we will email you a Returns Merchandise Authorization (RMA) number. Please complete this on the returns pro forma invoice that you received with your order, and include it with your return so we can process your credit promptly.

We recommend that you insure the return as you are under a duty to take care reasonable care of the goods and will be liable for damage to them until we receive them at our Escluso store. We also recommend that you use a secure , trackable means to return your order to us at Escluso store at 4, Stasikratous street P.Code 1065, Nicosia, Cyprus , and that you retain proof of sending , in case of a dispute. The return address is 4, Stasikratous street P.Code 1065, Nicosia Cyprus.

Please note that you must cover the cost of the return, as our free collection services does not apply to orders cancelled.

All items must be returned unused, in their original condition. If we do not receive the cancelled order, we can arrange to have it collected from you at your cost.

Refunds will be issued within 14 days, and the owed amount issued as a voucher to you. We may also exchange the item with another product of your choice. We do not refund money.

HOW TO RETURN OR EXCHANGE

Making a return or exchange is easy. Just make sure you request a Returns Merchandise Authorization (RMA) number within 14 days of receiving your order.

RECEIVING YOUR RMA

Sign into your account and under My Orders, select the order number, containing the items you would like to return.

Click on the CREATE A RETURN / EXCHANGE button and choose the reason why you want to send your item(s) back. If an item is faulty, please provide details.

Check the box to agree with our Returns Policy. You will then receive an email containing your RMA number which is valid for the next 14 days within which you can send your unwanted item(s) back to us.

EXCHANGES

There is no charge to exchange items for a different colour, however all exchanges are based on stock availability. Delivery is also free on the replacement item.

Simply request a Return Merchandise Authorization (RMA) number through your Escluso shop account within 14 days of receiving your order , and then specify the new colour you require.

Please note that we are only able to offer colour exchanges. If you wish to exchange your item for an alternative style, we suggest that you return it for a store credit and purchase the new separately.

You will be notified by email once your return has been received and processed.

GIFT RETURNS

If you have received an item as a gift, you may exchange it for a store credit to your Escluso account (you will need to register your details). The amount is automatically deducted from your next purchase . You may need to pay any cost difference, additional delivery.

Note, corporate gifts may only be returned by the original purchaser and within 14 working days of initial receipt.

LATE RETURNS

An RMA number should be requested within 14 days of receiving your order. You should then return your item(s) within 14 days of receiving this number.

Returns outside of this timeframe may be accepted at the discretion of Escluso shop and may only be refunded as a store credit.

OUR POLICY

Items should be returned new, unused, and with all Escluso shop and designer tags still attached. Returns that are damaged, soiled or altered may not be accepted and may be sent back to the customer.

Where provided, belts and any designer packaging such as authenticity cards, dust bags and leather tags should be included with your return.

All items returned should have a Return Merchandise Authorization (RMA) number. Unidentified returns may be returned to the sender.

FAULTY GOODS

Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within 3 weeks of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty.

Where possible, we will offer to repair faulty items. If you would like to exchange your item, please be aware that we can only replace it for the same product in the same size, subject to availability. You will receive a full credit if the item cannot be repaired or replaced.

IMPORTANT INFORMATION

All items are quality controlled and checked for any faults before they are dispatched to customers. Should you receive an item that is not in perfect condition please contact us immediately.

Please send all items you wish to return from an order in the same delivery to ensure your return is processed as quickly as possible.

Items should be returned in their original packaging to ensure that they are adequately protected in transit.

We prefer that items are returned to us via the Gap Vassilopoulos for Cyprus , EMS/DATA POST for Europe / International , to ensure that they are protected and insured during transit. WHAT PERSONAL INFORMATION DO WE COLLECT FROM YOU AND HOW?

Escluso shop collects personal information in several ways when you place an order , buy a gift voucher for a friend or register for a service offered by Escluso shop. By registering, you are consenting to the collection of your personal data. If an order is placed with us, we need to hold personal information including your name, email, address, phone numbers, home address, credit/debit card billing address (es) so that we can proceed to fulfill your order.

Saved card details will never be shared with third parties and will only be used to process your order, using our payment systems. Additionally we may also obtain information as a result of authentication or identity checks. Sometimes we may ask for your telephone number. This number may be given to our courier for delivery services. These details allow us to process your order and to let you know the status of your order.

HOW YOU CAN ACCESS AND IF NECESSARY CHANGE THE PERSONAL INFORMATION ESCLUSO SHOP MAINTAINS

If for any reason you are concerned that the personal information held by Escluso shop is not correct , please visit the website and, after logging into the site using “Sign In” menu on the home page , your personal information will be made available for review and change in the “My Account” section. Only you or, upon your request the relevant department , may access your personal data from the website using your password and User ID.
